Terms of Service

These terms define what the Foreclosure Auction Data research platform does, what it does not do, the limitations of auction and property data, and the responsibilities that apply when using the service.

These Terms of Service ("Terms") govern access to and use of ForeclosureAuctionData.com and the Foreclosure Auction Data research platform ("FAD," the "Service," "we," "us," or "our"). By accessing or using the Service, creating an account, purchasing a subscription or credits, unlocking research, using a paid feature, or downloading an export, you agree to these Terms. If you do not agree, do not use the Service.

1. What Foreclosure Auction Data is

Foreclosure Auction Data is a private information, research, and workflow platform focused on Florida foreclosure and tax deed auctions. The Service compiles, organizes, normalizes, matches, preserves, and analyzes information from public records, government systems, auction systems, property-appraiser records, court-related sources, GIS data, sales-history data, and other licensed or lawfully accessible sources. Features can include auction calendars, maps, property research, historical auction results, sales comparables, estimated values and equity, saved or followed properties, simulated bids, owner-outreach tools, exports, alerts, and related analytical functions.

A FAD property page is a research record. It is not a real-estate listing, an offer to sell the property, a statement that FAD owns or controls the property, or a representation that the property is presently available for purchase. Historical pages may remain available after an auction is postponed, cancelled, sold, vacated, satisfied, rescheduled, or otherwise changed because historical research is part of the Service.

2. No government affiliation

FAD is not a court, clerk of court, tax collector, property appraiser, county, municipality, sheriff, auctioneer, title company, law firm, real-estate brokerage, lender, appraiser, or government agency. Government names, public-record references, source links, parcel information, court information, and auction information are used to identify and organize research sources and do not imply sponsorship, endorsement, partnership, or affiliation.

FAD is also independent of search engines and third-party platforms. The appearance of a FAD URL in Google, Bing, a social network, or another third-party service does not make FAD part of that service or mean that FAD initiated an action taken by that third party.

3. Research service only, not professional advice

Nothing in the Service is legal, tax, accounting, investment, appraisal, title, lending, insurance, bidding, construction, property-condition, or other professional advice. FAD does not act as your attorney, title agent, broker, appraiser, fiduciary, auction representative, lender, or investment adviser. You are responsible for obtaining appropriate professional advice and conducting independent due diligence before taking action.

4. Public-record and source data

Information can originate from multiple independent sources that use different identifiers, schedules, terminology, formats, update cycles, and correction procedures. FAD may standardize names and addresses, match parcels and auction records, create permanent research identifiers, preserve prior observations, calculate derived fields, and resolve conflicts according to internal data rules. These transformations are intended to make research more usable but do not make FAD the official source of the underlying record.

The fact that a person, entity, address, parcel, case, bidder, purchaser, or owner appears in FAD does not mean that the subject created an account, consented to inclusion, supplied information to FAD, or has any customer relationship with FAD. Public-record inclusion and customer-account information are separate.

5. Data limitations and your verification duty

Data may be incomplete, delayed, stale, duplicated, normalized, estimated, inferred, mis-keyed, changed by a source after collection, or affected by matching or source-system errors. Auction dates, status, location, case information, judgments, plaintiff maximum bids, opening bids, bids, purchasers, sale results, market values, equity estimates, parcel boundaries, ownership, liens, occupancy, title, redemption rights, bankruptcy, taxes, code issues, association claims, property characteristics, and other facts can change without notice.

You must verify every material fact with the applicable authoritative source before bidding, buying, selling, financing, insuring, contacting a party, mailing an owner, entering a property, performing title work, or making another decision. Depending on the issue, authoritative verification can require review of the clerk or court docket, official auction site, tax collector, property appraiser, recorded instruments, title search, bankruptcy records, municipal records, association records, or other source outside FAD.

6. Auction dates, status, and historical records

An auction record reflects information collected or observed from source systems at particular times. A scheduled auction can be cancelled, postponed, rescheduled, redeemed, paid, stayed, vacated, dismissed, sold, reversed, or otherwise modified. A sold result can later be affected by a failed payment, vacated sale, court order, cancellation, settlement, satisfaction, or other post-auction event. FAD does not guarantee that an event occurred exactly as originally scheduled or that a displayed status remains current after the latest observation.

Historical records may remain in the database to support research into prior auction activity and sale outcomes. A historical record must not be interpreted as a statement that the property is currently distressed, currently for sale, or presently subject to an active auction.

7. Estimated values, comparables, debt bases, and equity

Market values, comparable-sale analyses, assessed or just values, debt or bid bases, estimated equity, scores, rankings, similar-property results, hotspots, rental assumptions, and related calculations are analytical research aids. They are not appraisals, broker price opinions, title commitments, payoff statements, lien searches, guarantees of proceeds, or representations that a property can be acquired, financed, insured, occupied, rehabilitated, rented, or resold at a particular value.

Estimated equity is generally a mathematical research estimate based on available value and debt or bid inputs. It does not account for every lien, senior claim, tax, association obligation, municipal charge, bankruptcy issue, title defect, occupancy cost, property-condition problem, repair expense, legal expense, transaction cost, redemption right, or other factor that can affect actual economics. Positive estimated equity is not a recommendation to bid or an assurance of profit. Negative or unknown estimated equity is likewise not a definitive valuation conclusion.

8. Not for consumer-reporting or eligibility decisions

The Service is designed for property and auction research, not consumer eligibility screening. You may not use FAD data as a consumer report or to determine a person's eligibility for credit, insurance, employment, tenant or housing screening, or another purpose governed by the Fair Credit Reporting Act or similar consumer-reporting law. FAD does not represent that public-record owner or party information is verified or suitable for those purposes.

9. Auction participation and investment risk

Foreclosure and tax deed auctions can involve substantial financial and legal risk. Deposits, bidding rules, payment deadlines, title consequences, lien priority, redemption rights, bankruptcy stays, occupancy, property condition, code violations, association claims, taxes, municipal charges, and county-specific procedures can materially affect a transaction. FAD does not control an auction and cannot guarantee that you will be permitted to bid, win, receive title, obtain possession, obtain insurable title, recover a deposit, finance a purchase, or earn a return.

You are solely responsible for your bid amount, maximum bid, funding, deposit, payment, title review, property investigation, professional advice, and decision whether to participate. A simulated bid or other FAD research feature is hypothetical and does not place a bid with an auction provider.

10. Accounts, eligibility, and security

You are responsible for maintaining accurate account information, safeguarding credentials, restricting access to your account, and all activity performed through your account unless applicable law provides otherwise. You may not share, resell, transfer, or pool account access in a manner that circumvents plan limits, credits, licensing, security controls, or usage restrictions. Notify us promptly if you believe credentials or account access have been compromised.

11. Paid services, credits, subscriptions, and exports

Prices, plan limits, credit costs, bundle discounts, and included features are displayed at purchase or use. Credits and paid access are contractual rights to use specified FAD features and data. They are not bank deposits, escrowed funds, stored-value accounts, securities, or ownership interests.

Unless otherwise required by law or expressly stated at purchase, completed research unlocks, generated exports, consumed credits, and delivered subscription periods are non-refundable once delivered or used. Recurring subscriptions continue until cancelled in accordance with the billing controls provided by the Service, and cancellation ordinarily stops a future renewal rather than reversing a prior period already provided. Taxes, processor rules, chargebacks, refunds, and payment disputes may be handled as required by law and applicable payment-network rules.

12. Limited license and permitted use

Subject to these Terms and the applicable plan, FAD grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for lawful research, due diligence, internal analysis, and other functionality expressly provided by the product. Authorized exports may be used for your lawful internal business or research purposes subject to any restrictions displayed with the export or plan.

13. Prohibited use

You may not:

  • scrape, crawl, spider, harvest, bulk-download, or automatically extract the Service except through an authorized FAD export or expressly permitted interface;
  • resell, sublicense, mirror, republish, redistribute, or build a competing database, auction-data service, or substitute product from FAD's compiled data or proprietary output;
  • bypass credits, subscriptions, authentication, rate limits, access controls, security measures, or technical restrictions;
  • interfere with, overload, probe, reverse engineer, disrupt, or attempt unauthorized access to the Service, servers, databases, accounts, or connected systems;
  • misrepresent FAD output as an official court, county, title, appraisal, government, or auction record;
  • use the Service for fraud, stalking, harassment, unlawful discrimination, identity theft, trespass, threats, deceptive impersonation, or another unlawful purpose;
  • use owner or party information in violation of applicable privacy, solicitation, advertising, fair-housing, consumer-protection, licensing, do-not-contact, or communications laws; or
  • use FAD for a prohibited consumer-reporting or eligibility purpose described above.

14. Owner outreach, letters, labels, and contact tools

Letter templates, labels, owner information, contact-related fields, and outreach tools are user-directed research and communication aids. You are responsible for verifying the intended recipient, mailing address, content, required disclosures, licensing, consent, and compliance with all laws applicable to your communication. Publicly available ownership information does not grant permission to harass, deceive, threaten, or unlawfully solicit a person.

Unless a separately identified service expressly states otherwise, FAD does not send physical mail on your behalf and does not become a party to communications you choose to send using information or templates obtained from the Service.

15. Third-party services, government sources, and integrations

FAD may link to, obtain information from, publish through, or incorporate functionality from government agencies and third parties such as payment processors, mapping providers, analytics systems, email providers, social platforms, and advertising-measurement providers. Those services are independently controlled, can change, become unavailable, correct records, impose rate limits, or apply their own terms and privacy policies. FAD is not responsible for a third party's separate service, content, availability, security, or decision.

16. Intellectual property and database rights

FAD owns or licenses the Service software, user interface, compilation, organization, transformations, matching logic, derived fields, scoring, analytical presentation, design, branding, documentation, and other proprietary materials, excluding underlying public records and third-party materials that remain subject to their respective rights. No rights are granted except the limited use rights expressly stated in these Terms.

Public availability of an underlying government record does not grant a user the right to copy FAD's proprietary compilation, interface, derived analysis, database structure, or substantial portions of the Service.

17. User-provided content and feedback

If you submit support material, correction information, feedback, suggestions, or other content to FAD, you represent that you have the right to provide it. You grant FAD the rights reasonably necessary to process the submission, respond to it, improve the Service, correct data, investigate a problem, and maintain appropriate business records. Do not submit confidential third-party information that you are not authorized to provide.

18. Service changes, maintenance, and availability

We may modify, add, remove, suspend, rate-limit, discontinue, or replace features, sources, plans, integrations, data fields, algorithms, or interfaces. We may perform maintenance and may temporarily restrict access for security, operational, legal, or technical reasons. We do not guarantee uninterrupted availability, permanent retention of every source record, compatibility with every device, or continued availability of any particular third-party source.

19. Privacy and data handling

Use of the Service is also subject to our Privacy Policy. Account and connected-platform deletion information is available at Data Deletion. Privacy choices for optional analytics and marketing technologies are available through the Privacy Choices control in the site footer.

A public-record property page and a FAD customer account are different things. Deleting a FAD customer account does not automatically delete an independently sourced public record, and the appearance of a property or owner in FAD does not mean that the owner is a FAD user.

20. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, DATA, ANALYSES, EXPORTS, MAPS, IMAGES, LINKS, AND OTHER CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." FAD DISCLAIMS WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND RESULTS, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

NO STATEMENT IN FAD CREATES A WARRANTY THAT A PROPERTY IS IN AN ACTIVE AUCTION, HAS A PARTICULAR VALUE OR EQUITY POSITION, IS FREE OF LIENS, IS OCCUPIED OR VACANT, CAN BE INSURED OR FINANCED, OR CAN BE ACQUIRED OR RESOLD AT A PROFIT.

21. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAD AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS; LOST REVENUE; LOST DATA; LOST OPPORTUNITIES; FAILED OR EXCESSIVE BIDS; MISSED AUCTIONS; DEPOSITS; TITLE OR LIEN LOSSES; PROPERTY-CONDITION ISSUES; POSSESSION OR EVICTION COSTS; FINANCING FAILURES; OR DECISIONS BASED ON DATA OR THIRD-PARTY SOURCE INFORMATION.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, FAD'S AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO FAD FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT RESULT.

22. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FAD and its owners, affiliates, employees, contractors, and providers from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Service, violation of these Terms, infringement or violation of third-party rights, communications or outreach you initiate, data you submit, or representations and decisions you make using FAD information.

23. Suspension and termination

We may suspend, restrict, or terminate access for fraud, abuse, chargebacks, security threats, unlawful conduct, material breach, unauthorized automation, scraping, credential sharing, attempts to circumvent technical or commercial controls, or other conduct that threatens the Service or other users. You may stop using the Service at any time, subject to obligations associated with charges already incurred and terms that by their nature survive termination.

24. Changes to these Terms

We may revise these Terms as the Service, pricing, features, law, or business practices change. The current posted version and effective date will appear on this page. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law. Where applicable law requires additional notice or consent, we will provide it.

25. Governing law and venue

Unless applicable law requires otherwise, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. For disputes not subject to another enforceable dispute process, exclusive venue will lie in a state or federal court in Florida that has subject-matter and personal jurisdiction over the dispute.

26. General terms

If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign or transfer your rights under these Terms without FAD's prior written consent, except where applicable law provides otherwise. FAD may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service.

These Terms, together with the Privacy Policy, applicable purchase terms, and any feature-specific terms presented to you, constitute the agreement governing your use of the Service and supersede prior statements concerning the same subject matter to the extent of a conflict.
